% 01.08.2017 IA 8031/2017 (u/O XXIII R.1&3 CPC) By this application the plaintiff seeks leave to withdraw the suit as an out of Court settlement has been arrived at between the parties who have amicably resolved their disputes in the present suit. The application is supported by the affidavit of Rohit Mehta who is the power of attorney holder of the plaintiff and his special power of attorney is at pages 64 to 65 of the document file.
Mr. Rohit Mehta is also present in Court and is identified by the learned counsel who seeks to withdraw the present suit on behalf of the plaintiff.
Application is disposed of permitting the plaintiff to withdraw the suit.

CS(COMM) 112/2016 & IA Nos. 2151/2016, 10159/2016, 4700/2016 and 4701/2016 Learned counsel for the plaintiff submits that the cost as imposed vide order dated 21st July, 2017 has deposited.
In view of the application being IA 8031/2017 and the statement of Mr. Rohit Mehta, the authorized representative of the plaintiff, the suit and applications are dismissed as withdrawn.
Mr. Rohit Mehta has signed the order sheet in acknowledgement of his statement made above.
Since the suit has been withdrawn pursuant to an out of Court settlement arrived at between the parties, Court fees be returned to the plaintiff as per Section 16A of the Court Fees Act. IA Nos. 9010/2016 & 9009/2016 (on b/o Defendants) Dismissed as infructuous.
