This petition is filed on behalf of the Petitioner under Section 11(6) of Arbitration and Conciliation Act, 1996 ('1996 Act') seeking appointment of Sole Arbitrator to adjudicate the disputes between the parties. 2.
As per the Petitioner, Respondent and the Petitioner entered into a Brand Ambassador Agreement on 01.10.2020, whereby Petitioner was appointed as Brand Ambassador to promote, endorse and market Respondent's product in India for a period of three years. Disputes arose on account of alleged non-payment of outstanding dues of the Petitioner and Petitioner sent a legal notice to the Respondent on 06.01.2025 to clear the dues, followed by notice invoking arbitration on 05.03.2025 in accordance with Arbitration Clause 19 in the Agreement dated 01.10.2020. Mr. Kunal Khanna, learned counsel for the Respondent, on instructions, submits that Respondent has no objection to the appointment of Sole Arbitrator. Parties propose and agree to the appointment of Dr. Justice S. Muralidhar, former Chief Justice of Orrisa High Court (Mobile No. 9872727986) as Sole Arbitrator.

Accordingly, this petition is allowed appointing Dr. Justice S. Muralidhar as the Sole Arbitrator to adjudicate the disputes between the parties. Fee of the Arbitrators shall be fixed as per Fourth Schedule of 1996 Act.

Learned Arbitrators shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
