The petitioner in the present petition assails the withdrawal order dated 08.06.2023 passed by ERC whereby the recognition granted to petitioner for B.Ed. Course with 100 seats (two basic units) was withdrawn. The appeal preferred by petitioner against the said order also came to be dismissed by the Appellate Committee vide impugned order dated 27.02.2024.

Mr. Amitesh Kumar, learned counsel appearing on behalf of petitioner submits that withdrawal of recognition is essentially on the ground that petitioner is not meeting the requirement of requisite qualified faculty. college is required to have 16 faculty including Principal. He fairly states that the petitioner college, at present has only 13 faculty members including HOD. He submits that petitioner is confining its prayer for restoration of 50 seats (one basic unit), since the requirement for 50 seats is only 8 faculty members, which indisputably petitioner is fulfilling. The aforesaid factual position is not disputed by Mr. Mohinder J.S. Rupal, learned counsel appearing on behalf of respondent nos.1 to 3/NCTE. 3.
In view of the above, the present petition is allowed. 4.
Accordingly, impugned order dated 08.06.2023 passed by ERC and the order 27.02.2024 passed by the Appellate Committee are quashed. 5.
Consequently, respondent no.3/ERC is directed to restore the recognition of petitioner qua 50 seats (one basic unit) within a period of 10 days.
The respondents are directed to communicate to the affiliating university, i.e., Bahasaheb Bhimrao Ambedkar Bihar University as well as the State Government within a period of one week thereafter. The respondents are further directed to update the status of petitioner on their website within a period of one week.

Insofar as the remaining 50 seats are concerned, the following directions are passed:
(i) The NCTE is directed to carry out fresh inspection in terms of Section 13 of the NCTE Act and inform the petitioner institution about recommendations, if any, on the basis of such inspection; (ii) In the event any deficiencies are pointed out in the recommendations, NCTE will grant reasonable time to the petitioner institution to rectify the same; and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
(iii) If no deficiencies are recommended, or in case deficiencies recommended by NCTE are rectified by petitioner institution during the time period granted to it, ERC will restore the recognition of petitioner institution for B.Ed. course (one basic units-50 seats), and consequently, NCTE shall communicate about the restoration order to the affiliating university of the petitioner institution, as well as, to the State Government. Further, NCTE will also do the needful with regard to updation of the status of petitioner institution on its website.

In view of above, petition stands disposed of. 8.
Pending applications stand disposed of.
