Mr. Rajesh Kumar, learned SPC appearing on behalf of R-1/UOI, on instructions from the Principal of respondent no.3/PM Shree Jawahar Navodaya Vidyalaya, Mungeshpur, Delhi-110039, who is present in Court, submits that there is no seat available in the respondent no.3/school. 2.

In view of the above statement, Mr. Kundu seeks to withdraw the present petition with liberty to file a fresh in case any vacancy arises in future.

The petition alongwith pending application is dismissed as withdrawn with liberty as aforesaid.
