The present Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the petitioner seeking parole for a period of three months to maintain social ties, to perform last ritual of his younger sister who died on 02.04.2023, to construct the house and family relations and to curb inner stress, in FIR No. 248/2010 registered under Sections 376(2)(G)/365/506/34 of the Indian Penal Code, 1860 at Police Station Dhaula Kuan, Delhi. 2.

Issue notice.

Mr. Rahul Tyagi, learned Additional Standing Counsel appearing on advance notice, accepts notice on behalf of the State. 4.

It is submitted on behalf of the petitioner that the petitioner had filed the application seeking parole on 26.07.2023, however, the same has not yet been decided till date.

during the pendency of the present petition, the application of the petitioner seeking parole has been declined vide Order dated 19.10.2023. 6.

In these circumstances, the petitioner is at liberty to challenge the Order dated 19.10.2023 in accordance with law or to file a fresh parole application as the case may be.

With the aforesaid directions, the present petition along with pending application is disposed of.
