The present petition has been filed by some of the plaintiffs in whose favour there is already a decree.

Such decree is under challenge before the learned District Judge and during the pendency of such appeal, an application seeking stay on the operation of execution of the judgment and decree was filed. 3.

While considering the abovesaid application, the learned First Appellate Court directed the appellants to deposit a sum of Rs.25 lacs as security. also records that the undertaking given by the appellants at an earlier point of time shall also continue to remain in operation till the disposal of the appeal.

According to the petitioners, there was no reason or occasion to have stayed the operation of the judgment/decree. Learned counsel for respondents appear on advance notice and submits that such security has already been furnished and the appeal is now listed for final arguments on 12.07.2025.

After hearing arguments for some time, learned counsel for the petitioner submits that, without prejudice to his rights and contentions, he does not press the present petition. He, however, submits that the learned First Appellate Court may be requested to dispose of the appeal as expeditiously as possible.

The petition is accordingly disposed of in the above terms. Learned First Appellate Court would make best endeavour to dispose of the appeal, in accordance with law, as early as possible.
