Learned counsel for the petitioner submits that the petitioner was allotted Shop No. B-2, Ancilliary Block, Ground Floor, Fish Market, Ghazipur, Delhi, vide a letter of the respondent dated 29.01.2003 at a monthly license fee of Rs. 8,025/-.

It is the petitioner's case that similarly situated applicants were granted lease rights on existing shops. She submits that the petitioner fulfils all eligibility criteria and is entitled for similar treatment. It is also contended that the petitioner has been charged an increased license fee, which has been subjected to numerous increments, while other allottees had been paying the fee on the unchanged amounts. Is there any clause in agreement with traders for enhancement of licence fee. Please provide the copy of Deed of Licence Agreement.

Learned counsel appearing for the respondent submits that the petitioner has not paid the necessary fees requiring the extension of the licensee rights qua the shop in question.

After hearing the parties at some length, learned counsel appearing for the petitioner confines his prayer to the extent of directing the respondent to decide the petitioner's representation keeping in mind the fact that similarly situated shops were granted on lease basis to other applicant. 5.

The Court, thus, finds that the matter can be disposed of with the following directions:

Let the petitioner to file a fresh representation enclosing all documents to justify the allotment of the shop on a legal basis. ii.
