Petitioner is plaintiff before the learned Trial Court and is aggrieved by order dated 03.07.2024 whereby his application seeking amendment in the plaint has been dismissed.

Learned counsel for petitioner states that the amendment was formal in nature and had occasioned in view of the answers given by defendant No.1 during the cross-examination.

Be that as it may, after hearing arguments for some time, learned counsel for petitioner states that he does not wish to press the present petition. He, however, submits that liberty may be granted to petitioner to agitate the aspect related to consideration of the sale in question, within the scope and ambit of the pleadings, at the time of the final arguments. 4.

In view of the aforesaid, the present petition is dismissed as not pressed. Liberty, as prayed, is granted.
