The present Petition has been filed by the Petitioner inter-alia stating that the Respondent/Contemnor is in violation of order dated 17.11.2023 passed by a Coordinate Bench of this Court in RFA479/2023. The attention of this Court has been drawn to paragraph 4 and 5 of the order dated 17.11.2023 to submit that the Court had directed Respondent/Contemnor to file an undertaking before the Court in the event, it creates any third party interest in the subject property.

Learned Counsel for the Respondent/Contemnor, who appears on advance Notice, submits that, inadvertently the undertaking which was directed to be filed by the order dated 17.11.2023 has not been filed. He seeks and is granted three days additional time to file the same. Let the same be filed with an advance copy to the learned Counsel for the Petitioner. 3.

In this view of the matter, learned Counsel for the Petitioner seeks and is granted liberty of the Court to withdraw the present Petition and to move an appropriate Petition, if the need arises.
