By way of present petition, the petitioner has sought to assail the order dated 01.09.2023 passed by learned ASJ-03, North, Rohini Court, New Delhi in CA 180/2023 vide which the petitioner was directed to pay 20% of the compensation amount in the appeal proceedings arising out of Section 138 of the Negotiable Instruments Act, 1881. 2.
It is noted that on 17.10.2023, while issuing notice, this Court noted the submission of the petitioner that the prayer in the present petition is restricted to the extent of seeking reduction of compensation amount from 20% to 10%. On 22.02.2024, the petitioner was present and stated that he does not seek reduction of the surety amount as the same has already been furnished. Insofar as payment of 20% is concerned, this Court noted that the petitioner has failed to make any exceptional grounds for the interreference, accordingly, the stay application was dismissed. 3.
