O R D E R

By way of the present bail application, the applicant seeks interim bail for a period of 45 days in FIR No. 284/2024 dated 06.12.2024, registered at Police Station Hazarat Nizamuddin, for offences under Sections 20/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ('NDPS').

The status report though indicates that emergent medical situation does not exist in regard to the medical condition of the applicant, it is however not denied that applicant's son has been suffering from Tuberculosis and may also require surgery in regard to exploration of wounds.

The applicant had, on earlier occasion, been granted the benefit of interim bail on the same grounds and the liberty was not misused during the period of interim bail and the applicant was not found to be indulging in similar violations, as alleged in the present case.

In the opinion of this Court, looking at the past conduct of the applicant, while being released on interim bail as well as her Previous Conviction Report, it is not likely that she would commit or indulge in similar violations.

In view of the above, purely on humanitarian grounds, the present bail application is allowed and the applicant is directed to be released on interim bail for a period of one week, on furnishing a personal bond of ₹25,000/- with two sureties of the like amount to the satisfaction of the concerned Jail Superintendent and on the following conditions: a. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever;
b. The applicant shall provide the address where she would be residing after her release and shall not change the address without informing the concerned Jail Superintendent;
c. The applicant shall, upon her release, give her mobile number to the concerned Jail Superintendent and shall keep her mobile phone switched on at all times;
d. The applicant shall under no circumstance leave the boundaries of the country.

The applicant is directed to surrender upon the expiry of the period of interim bail.
