% 11.03.2025 CM APPL. 13516/2025 (Release Of Amount) The present application has been filed under Section 151 CPC seeking release of amount of Rs. 20,00,000/- deposited in compliance of order dated 06.01.2022 with the Registry of this Court.

Mr. Jai Sahai Endlaw, learned counsel for the appellant/applicant submits that after to the dismissal of the present appeal by this Court vide order dated 27.11.2024, the parties have reached on a out of Court settlement in respect of decree dated 23.10.2021 Ld. AdditionalDistrict Judge-03 (Central) Tis Hazari Courts, Delhi in RCA DJ No.148 of 2018. Learned counsel for the appellant further submits that execution petition bearing Ex. 326/2019pending before Ld. Senior Civil Judge, West District, Tis Hazari Courts, Delhi has also been withdrawn by the decree holders on 07.03.2025 Pursuant to the notice Sh. Respondents have also appeared through VC and states that they have no objection if the amount is allowed to be withdrawal. In view of the out of the Court settlement and the submissions made by Sh. Subodh Khanna, Attorney of all the respondents. Let the amount deposited by the appellant pursuant to the order dated 06.01.2022 be released to the applicant/appellant along with the accrued interest, if any, subject to the verification as per rules.
