This petition has been filed seeking quashing of FIR No.534/2023 PS Kalyanpuri under Sections 498A/406/34 IPC on grounds of settlement arrived at between the parties dated 16th October, 2023 with the facilitation of the Delhi Mediation Centre, Karkardooma Courts, Delhi. 2.

As per the settlement, an amount of Rs.8 Lacs is to be paid to respondent No.2/complainant. Out of which, a balance of Rs.3 Lacs is being tendered vide DD No.811288 drawn on Indian Bank and has been handed over to respondent No.2, who has accepted the same. present in Court, duly identified by the IO; as well as respondent No.2/complainant who states that she does not have any objection to the quashing of the FIR.

The petitioner No.1 and respondent No.2 were married on 20th May, 2022 but due to matrimonial discord the marriage stands dissolved by decree of divorce dated 30th May, 2024. No child was born out of wedlock. 4.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No.534/2023 PS Kalyanpuri under Sections 498A/406/34 IPC and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 6.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
