These petitions have been filed under Sections 14 and 15 of the Arbitration and Conciliation Act, 1996 ('the Act') seeking termination of the mandate of the present Arbitrator and substitution with a new Arbitrator. 2.
It is stated that the earlier Arbitrator Justice V.B. Gupta, former Judge of this Court, who was appointed by this Court as the Sole Arbitrator has recused from the arbitration proceedings vide order dated 19th February, 2025.

To be noted, the recusal happened at the time of 78th hearing in the arbitration proceedings.

Mr. Vivekanand, counsel appearing on behalf of the respondents does not oppose the substitution.

Accordingly, the present petition is allowed and Justice V.K. Jain (Mobile No. +91 9650116555), former Judge of this Court, is appointed as a Sole Arbitrator to adjudicate the dispute between the parties. The following directions are issued in this regard: a.
The arbitral proceedings shall be held under the aegis of the Delhi International Arbitration Centre, Delhi High Court, Sher Shah Road, New Delhi (hereinafter 'DIAC').
b.
The Arbitrator is requested to furnish a declaration in terms of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Section 12 of the Act prior to entering into the reference. In the event there is any impediment to the Arbitrator's appointment on that count, the parties are given liberty to file an appropriate application before this Court.
c.
The remuneration of the Arbitrator shall be in terms of fees schedule of DIAC.
d.
The parties shall approach the Arbitrator within two (2) weeks from today.

All the petitions stand disposed of in the aforesaid terms. 7.
Considering that the arbitration proceedings have been ongoing since 2010, the learned Sole Arbitrator is requested to decide the matter in an expeditious manner.
