Petitions under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') read with Article 227 of the Constitution of India have been preferred on behalf of the petitioners for quashing of FIR No. 267/2023 under Sections 498A/406/506/354/354A/34 IPC registered at P.S.: Shahdara and proceedings emanating therefrom.

Learned APP for the State and learned counsel for respondent no. 2, appear on advance notice. Learned APP for State informs that chargesheet has since been filed and petitioners have appeared before Ld. JM after filing of chargesheet.

At this stage, learned counsel for petitioners submits that since the present petitions have been preferred prior to filing of chargesheet, he may be permitted to withdraw the petitions with liberty to file the same afresh after making relevant references to evidence, if any, appearing, against the petitioners in the chargesheet.
