The present petition under Article 226 of the Constitution of India read with Section 528 of the BNSS seeks following prayers:- "a. Set aside the order dated 07.07.2025 passed by the Ld. JMFC, Dwarka Courts whereby the Respondent No. 2/Accused was allowed to travel abroad and further allowed renewal of passport for a period of 10 years and suspended lookout circulars against the Respondent No. 2/Accused in FIR No.86/2022 registered at PS EOW under Sections 120B, 406, 409, 420, 467, 468, and 471 IPC;
b. Issue Look Out Circular against the Respondent No. 2/Accused preventing him to travel abroad and leave the jurisdiction of this Hon'ble Court;
c. Subject to prayer clause 'b' above, direct the Agencies to take remedial actions to bring back the Respondent No. 2/Accused to the Jurisdiction of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. this Hon'ble Court in case the Respondent No. 2/Accused already left the jurisdiction of this Hon'ble Court; d. Pass such other orders as this Hon'ble Court may deem fit and proper in the interest of justice." 3.
Learned Senior Counsel appearing on behalf of respondent no. 2 on advance notice points out that the present petition has become infructuous on account of the fact that respondent no. 2 had applied for renewal of the passport which has not been renewed. It is further pointed out that permission to travel abroad was sought on the ground of his daughter's graduation ceremony which was scheduled for 10.07.2025. In these circumstances, it is submitted that the respondent no. 2 will not be able to avail of the permission granted to him to travel abroad from 08.07.2025 to 12.07.2025. 4.
In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition without going into the merits of the case and with liberty to file afresh in case fresh permission is granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
