The present Revision Petition under Sections 397/401 of the CrPC has been filed on behalf of the petitioner to set aside the impugned Order dated 28.10.2022 passed by learned MM in Complaint Case No. 4193/2016 for non-prosecution and thereby acquitting the respondents. Further prayer is made that the Complaint Case No. 4193/2016 may be restored to be tried on merit before the learned Trail Court.

28.10.2022 dismissing the Complaint Case No. 4193/2016 and the present petition has been filed after almost two years. However, the present petition has been filed along with the Application bearing No. CRL.M.A. 20991/2024 under Section 482 of Cr.P.C. read with Section 5 of Limitation Act seeking condonation of 531 days' delay in filing the present petition, however, there is no explanation has been given by the petitioner in the condonation of delay application to condone the delay. 6.

Accordingly, there is no merit in the present petition which is hereby dismissed along with pending application.
