The matter was listed before the Court on 30.01.2025 when learned Counsel for the Respondent submitted that despite the Petitioners making several attempts, the cross examination of the Petitioners was not being concluded by the Respondent since the Respondent is taking unnecessary adjournments. The Court had requisitioned the order sheets in the matter which have now been received.

1.1 The order sheets reflect that multiple adjournment requests have been made by the Respondents. The Respondent No.1 is physically present in the Court today. He submits that he has not instructed his Counsel to take these adjournments.

Learned Counsel for the Respondents and the Petitioners submit that no further adjournments will be taken in the matter and that the matter will be concluded expeditiously before the learned Trial Court. 2.1.

The Parties are bound down by the statement made by their counsel. 3.

examination of PW-1 has concluded, his remaining witness(es) will be brought for examination/cross examination on the next date of hearing. 4.

Learned Counsel for the Respondents submits that he only has one witness. He further submits that he will conclude the cross-examination of the remaining witnesses of the Petitioners on the next date of hearing. 5.

The Petition is disposed of in the aforegoing terms making it clear that for each adjournment request made by the Respondents before the learned Trial Court, cost in the sum of Rs. 10,000/- shall be paid by the Respondents to a charity of his choice.

It is clarified that this order has been passed without prejudice to the rights and contentions of the parties, which are to be agitated before the learned Trial Court.
