Learned counsel appearing for the petitioner submits that he had already availed the remedy before the Appellate Tribunal-Municipal Corporation of Delhi ["AT-MCD"], however, on account of nonfunctionality of the AT-MCD, the petitioner had to approach this Court. 2.
This Court, while directing for issuance of notice to the respondents, had further directed the parties to maintain status quo vide its order dated 22.07.2024.

He, therefore, submits that as per instructions received by him, the AT-MCD has become functional and he be granted liberty to agitate all the objections before the AT-MCD.

In view of the aforesaid, leave and liberty, as prayed for, is granted. The petitioner shall pursue his remedy before the AT-MCD in accordance with law.

Let the petitioner to move an application within 10 days for stay before the AT-MCD, the same shall be decided expeditiously. 6.
Till the application for stay is decided by the AT-MCD, the order dated 22.07.2024 shall remain in force.

The petitioner undertakes that she will not alter the position of the building in question.
