CRL.M.A. 36850/2024 (for modification of order dt. 28.10.2024 by petitioner) 1.

By way of present application, the petitioner/applicant seeks modification of the order dated 28.10.2024 for release of the petitioner/applicant on furnishing personal bind only without surety. The application is premised on the ground that the petitioner/applicant is unable to arrange the surety.

Learned counsel for the petitioner/applicant submits that the petitioner/applicant is unable to arrange the surety as his wife is illiterate while his father has since expired.

Vide order dated 28.10.2024, the applicant/petitioner was directed to be released on first spell of furlough for a period of three weeks subject to him furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount.

Issue notice.

Notice is accepted by learned ASC (Crl.) for the State who states, upon instructions, that the address of the petitioner/applicant stands verified. 6.

Considering the aforesaid facts and circumstances and the fact that the applicant/petitioner has not been able to avail the benefit of the order passed on 28.10.2024, he is directed to be released on furlough on his furnishing personal bond and cash surety of Rs.10,000/-. 7.

The order dated 28.10.2024 stands modified to the aforesaid extent. 8.

The other terms and conditions as contained in the order dated 28.10.2024 shall remain the same.

The application is disposed of accordingly.

A copy of this order be communicated to the concerned Jail Superintendent for information and necessary compliance.
