This hearing has been done through hybrid mode. 2.
The present petition under Section 12 read with Section 2(b) of the Contempt of Courts Act, 1971 read with Section 151 of the CPC seeks the following prayers:
<a.
Pass an order initiating contempt proceedings against the Respondent, Mr. Kapil Dev, and issue notice thereof to the Respondent;
b.
Prosecute and punish the Respondent by directing arrest and detention of the Respondent in civil .prison under the provisions of the Contempt of Courts Act, 1971 for the wilful disobedience of the order dated August 18, 2022 passed by this Hon'ble Court in CS (OS) No. 439 of 2022;
c.
Pass an order directing the Respondent to pay an appropriate amount of fine under the provisions of the Contempt of Courts Act, 1971 for the wilful disobedience of the order dated August 18, 2022 passed by this Hon'ble Court in CS (OS) No. 439of 2022; d.
Pass an order directing the Respondent to, pending The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
adjudication of the present Petition, to comply with the order dated August 18, 2022 passed by this Hon'ble Court in CS(OS) No. 439 of 2022 and withdraw all correspondence, posts and messages issued by him on social media websites and all other electronic and print media;
e.
Pass an order awarding costs of the present Petition to the Petitioner; and f.
Pass such other order(s) in favour of the Petitioner as this Hon'ble Court may deem fit in the interest of justice.= 3.
In pursuance of order dated 18.09.2025, the respondent has placed on record a compliance affidavit showing compliance of order dated 18.08.2022 in CS(OS) 439/2022. Copy of the same has been handed up in Court today and is taken on record, wherein, it has been stated as under: <5. That I have tendered an unconditional apology to the Plaintiff company for the defamatory posts made by me in the past, which has been accepted by this Hon9ble Court as recorded in the said order.

That in compliance with the order dated 18.08.2022 and the subsequent directions of this Hon'ble Court, I state and affirm that I have not made or published any defamatory, derogatory, or disparaging post, statement, or remark against the Plaintiff company or any of its directors, employees, or affiliates on any social media platform, website, or in any other manner whatsoever, after the filing of the present petition. 7.
That I further undertake not to make, publish or circulate any such defamatory or derogatory statements or communications against the Plaintiff company, its associates, or its employees in the future, in any manner or through any medium.

That I submit this affidavit in compliance with the directions of this Court passed during the hearing conducted through hybrid mode, wherein I was directed to place on record an affidavit showing compliance of order dated 18.08.2022 in CS(OS) 439/2022 before the next date of hearing fixed on 03.11.2025. 9.
That the contents of this affidavit are true and correct to the best of my knowledge and belief, and nothing material has been concealed therefrom.= 4.
