O R D E R

% 16.02.2018 By the present petition the petitioners seek quashing of FIR No. 83/2017 under Sections 406/420/468/471/120B IPC registered at PS Economic Offences Wing, Delhi on the complaint of Respondent No.2 & 3 and the proceedings pursuant thereto on the ground that the parties have settled the matter.

Learned Additional Standing Counsel for the State on instructions from Investigating Officer submits that in the above-noted FIR the four petitioners and petitioner No.5 the company are the only accused and

respondent No.2 the company and respondent No.3 the Director of the company are the only complainant/ victim.

Respondent No. 3/ D.K. Gupta is present in Court and is identified by the learned counsel. He on his own behalf and on behalf of the respondent No.2 Southend Infrastructure Pvt. Ltd. authorization whereof is at page 44 of the paper book states that he and respondent No.2 have settled the matter with the petitioners No.1 to 5 and now the respondent No.2 & 3 have no claim whatsoever remaining against the petitioners and do not wish to pursue the above-noted FIR and the proceedings pursuant thereto. Petitioners No.1 to 4 and petitioner No.3 on behalf of petitioner No.5 by virtue of the Resolution dated 5th February, 2018 copy whereof is annexed as Annexure P2 at page 42 of the paper book affirm the statement of respondent No.2 and state that they have no dues qua respondent No.2 and 3.

In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.

83/2017 under Sections 406/420/468/471/120B IPC registered at PS Economic Offences Wing, Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

Petition is disposed of. Order dasti.
