An application under Order VI Rule 17 came to be filed by the plaintiff seeking certain amendments in the plaint. The Court takes note of the fact that the summons have not yet been issued in the suit. 2.
Therefore, instead of allowing the said application, the Court deems it appropriate to grant the liberty to the plaintiff to file a fresh civil suit. 3.
In view of the aforesaid, learned counsel for the plaintiff seeks liberty to withdraw the instant civil suit.

Liberty, so prayed for, is granted.
