This is an application under Section 483 BNSS, 2023 for the grant of regular bail in case FIR No. 625/2023, under Sections 377/506 IPC and Section 6 POCSO, registered at Police Station Narela. 2.
Learned counsel appearing for the applicant submits that investigation is complete and charge sheet has been filed. The applicant is in custody since 05.09.2023. He further submits that there is no public witness of the incident and all the allegations qua the present applicant are false and baseless.

It is further submitted that applicant has clean antecedents inasmuch as he is not involved in any other criminal case and is ready to abide by any condition imposed by this Court.

The bail application is opposed by learned APP appearing on behalf of State, arguing that applicant indulged in unnatural sex with the victim, who was then aged about 11 years. It is submitted that allegations qua the applicant are grave and serious in nature. It is further submitted that the trial is at the stage of defence evidence.

As per allegations, the applicant had lured the victim to his rented shop on the pretext of getting help from him in shifting certain boxes. When the victim came there, he closed the door from inside and committed unnatural sex with him. He threatened the victim that in case he tells someone about the incident, he would kill him. 6.
On 04.09.2023, due to pain, victim informed his mother, thereafter, a PCR call was made by the victim's uncle and FIR under Sections 377/506 IPC and Section 6 POCSO was registered at Police Station Narela. 7.
The status report reveals that exhibits i.e. Anal Swab, blood sample was preserved by the Doctor and FSL result confirms that DNA profile generated from the pants of victim matches with the DNA profile generated from the blood sample of the applicant.

Status report further confirms that as per school records, the date of birth of the victim was 18.10.2012. That being so, the victim was minor at the time of the alleged incident.

The allegations qua the applicant are grave and serious in nature. Hence, considering the nature and gravity of the allegations, severity of punishment that the offences may entail, upon conviction, as also the fact that trial is at the fag end, the Court does not find the present case a fit case for the grant of bail to the applicant.
