Various objections have been raised by the defendants, including the one which relates to the territorial jurisdiction of this Court to entertain the instant civil suit.

competent jurisdiction. He, therefore, seeks liberty to withdraw the instant civil suit with liberty to file the same before the Court of competent jurisdiction.

With the aforesaid liberty, the civil suit stands dismissed as withdrawn.

All rights and contentions of the parties are left open. 5.

Since the suit has been withdrawn, the Court deems it appropriate to direct for refund of the entire Court fees. Ordered accordingly.
