This petition has been filed by the petitioner with following prayers:- On the basis and in the light of above stated facts of Merits and Grounds I, humbly pray that The Hon'ble Court graciously be pleased to pass Directions or orders of Directions to Respondents for1. To consider the matter now of 'Not Considering of my of Promotion so far to the rank of Lt. (Sd.) and,
2. To consider delivering Parchment now of 'Not Delivering of Parchment Commission' to me and,
3. That if any delay by The Hon'ble Court be seen to Approach the Hon'ble Court may kindly be condoned in the interest of justice.

Though, on the last date of hearing, notice was issued on the petition, but we find that the jurisdiction insofar as the subject matter of the petition, i.e., service related matters with respect to promotion, shall lie before the Armed Forces Tribunal ('AFT', for short).

We accordingly deem it appropriate to close these proceedings by granting liberty to the petitioner to approach the AFT for the prayers as made in this petition. The period during which the petitioner has pursued the present petition shall be excluded for the purpose of computing the limitation in filing the petition before AFT. V.
