Present petition has been filed by the petitioner to transfer the complaint case instituted under Section 138 Negotiable Instruments Act before the Courts at Karkardooma.

It is informed by the learned counsel for the petitioner that due to inadvertence the complaint case has been filed at Karkardooma Courts whereas as per the observations of the learned Metropolitan Magistrate (Shahdara District), the said Court has no jurisdiction as per amendment 2015.

Since the respondent has yet not been served and the complaint case is at its initial stage, considering the observation of the learned Metropolitan Magistrate regarding lack of jurisdiction, the complaint case is transferred to the Courts at Saket for disposal as per law. 4.

The petitioner shall appear before the concerned learned District & Sessions Judge, Saket Courts on 19th March, 2018. The learned District & Sessions Judge shall assign the case to the Court of competent jurisdiction.

The petition stands disposed of.
