Section 401 of the Code of Criminal Procedure, 1973 (CrPC) inter alia, praying that Respondent No. 2 be directed to supply complete and legible copy of the complaint along with its documents.

The learned counsel for the petitioner submits that an application under Section 204(3) of the CrPC was filed on behalf of the petitioner seeking copy of the complaint filed by the respondents, and all the supporting documents. He submits that the said application was not taken up by the learned Metropolitan Magistrate, and notice was framed against the petitioner. 3.

There is some controversy whether the application under Section 204(3) of the CrPC filed by the petitioner was listed before the learned Metropolitan Magistrate on 19.08.2023 since the order dated 19.08.2023 does not reflect that any such application was taken up.

Mr. Gagan Chawla, learned counsel for Respondent No. 2 at the outset on instructions, submits that he has no objection if the documents as sought for are supplied. He submits that the same will be supplied by the within a period of one week from today.

In view of the above, the learned counsel for the petitioner does not press any relief in the present petitions and seeks liberty to withdraw the same.

The present petitions are dismissed as withdrawn, in the aforesaid terms.

A copy of order be placed in all petitions.
