parties for placing on record the Memorandum of Understanding cum Settlement Agreement (hereinafter 'MoU') dated 26.09.2024. 2.
Learned counsel for the parties jointly submit that in terms of the MoU dated 26.09.2024, the parties have settled their grievance. The said MoU is taken on record and it appears that the same has been entered without any coercion.

In view of the aforesaid, the impugned judgment and decree is modified to the extent of the terms and conditions of the aforesaid MoU. The parties are bound by the terms of the MoU. The demand draft of Rs.31,00,000/- has been handed over to learned counsel for the respondent, as a part compliance of the MoU. The said fact is placed on record. 3.
With the aforesaid directions, the applications stand disposed of. RSA 214/2019 RSA 216/2019 In view of the order passed in CM APPL 57863/2024 and CM APPL 57865/2024, both the appeals stand disposed of. The date already fixed, i.e. 09.10.2024 stands cancelled.
