The petitioner seeks to withdraw this petition on the ground of settlement recorded between the private parties. On being pointed out that the issue involved in the impugned proceedings under Section 145 CrPC is the apprehension of breach of peace and not civil rights of the parties, learned counsel for petitioner submits that his request may be confined to withdrawal simplicitor and the parties shall appear before the concerned SDM with the request to permit withdrawal of the complaint filed earlier by the present private respondents.
