At the outset, Ms. Shubhi Gupta, learned APP states that the matter is now listed before the learned Metropolitan Magistrate for committal to the Sessions Court.

Mr. Lovkesh Sawhney, learned Senior Counsel for the Petitioner seeks to withdraw the Bail Application, on instructions, in view of the fact that cognizance has been taken in the matter, with liberty to approach the Sessions Court after committal and to apply for regular bail. He, however, states that since the chargesheet was filed without arrest and this Court had also granted interim protection, the same be continued till the regular bail is filed by the applicant and decision is taken by the Sessions Court. Taking into account the fact that the chargesheet was filed without arrest and this Court has granted interim protection to the applicant as also that there are no allegations of non-cooperation in the investigation, this Bail Application is disposed of as withdrawn, recording the submission of learned Senior Counsel for the Petitioner, on instructions, that appropriate application seeking regular bail will be filed within seven days from the date of committal. Interim protection granted by this Court shall continue to operate till a decision is taken on the Regular Bail Application. The Sessions Court is requested to expedite the hearing of the application, as and when, the same is filed.

Needless to state that the Sessions Court shall deal with the Bail Application, if and when filed, on the merits of the case and in accordance with law, uninfluenced by any order passed by this Court in the present application, which is only an interim measure. 6.

Pending application also stands disposed of.
