O R D E R

This is a petition filed under section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Arbitrator. 2.

During the arguments, both the parties agreed that a new Arbitrator be appointed.

Since the fees as per the Fourth Schedule, has been already paid to the erstwhile Arbitrator, the parties agree that a cap be fixed on the fees charged by the newly appointed Arbitrator.

With the consent of the parties, Ms. Maninder Acharya (Senior Advocate) (Mob. No. 9810163078) is appointed as an Arbitrator to adjudicate the disputes between the parties. Further, the Arbitrator shall charge a fee of Rs. 1.5 lakhs per hearing subject to a maximum of Rs 7.5 lakhs which shall be shared equally.

It is further directed that the petitioner shall conclude its arguments within 2 months from the date of the Arbitrator entering reference and the respondent shall conclude its arguments within 6 weeks thereafter. The petitioner shall give a rejoinder within 2 weeks thereafter. 7.

The Arbitrator shall make and publish the Award within 2 months thereafter i.e., the arbitration shall be concluded within 6 months. 8.

The petition is disposed of in the aforesaid terms. 9.
