Learned counsel for the petitioner submitted that the CCTV footage filed before the Trial Court prima facie proves that the petitioner was not involved in the alleged offence, however, learned counsel for the petitioner further submitted that the Trial Court has not taken into consideration the said CCTV footage while deciding the bail application on 26.4.2019. Learned counsel for the petitioner further submitted that the petitioner shall be moving an application under Section 439 of the Code of Criminal Procedure, 1973 (Cr.PC) for regular bail before the Trial Court and the Trial Court may be directed to go through the CCTV footage while passing orders on the application under Section 439 of the Cr. PC to be filed by the petitioner.

In view of the aforesaid, learned counsel for the petitioner seeks permission to withdraw the bail application, with liberty to file a bail application under Section 439 of the

Cr. PC before the Trial Court and prays that the Trial Court may be directed to consider all the submissions of the petitioner in accordance with law while deciding his bail application. 3.

Accordingly, the bail application is dismissed as withdrawn, with liberty as prayed, subject to just exceptions. The Trial Court is directed to consider all the submissions of the petitioner in accordance with law while deciding his bail application.
