The petitioners have filed this petition under Section 11 of the Arbitration and Conciliation Act, 1996 ["the Act"], seeking appointment of an arbitrator to adjudicate disputes between the parties under a Collaboration Agreement dated 21.10.2020 ["the Agreement"]. 2.

Clause 47 of the Agreement provides for resolution of disputes by arbitration. Jurisdiction under the Agreement is also vested in Courts in New Delhi.

Disputes having arisen between the parties, the petitioners invoked the arbitration clause by a legal notice dated 29.06.2024.

The respondents, by their reply dated 08.07.2024, did not dispute the existence of the arbitration clause, but parties were unable to achieve consensus on the identity of the arbitrator.

Mr. Anish Gupta, learned counsel, appears on advance notice on behalf of the respondents, and submits that an independent arbitrator may be appointed to adjudicate the claims and counter claims of the parties. 5.

Having regard to the above, and with the consent of learned counsel for the parties, the disputes between the parties under the Agreement dated 21.10.2020, are referred to arbitration of Hon'ble Mr. Justice Vinod Goel, former Judge of this Court [Tel: 9910384637]. 6.

The arbitration proceedings will be held under the aegis of Delhi International Arbitration Centre, Delhi High Court, Shershah Road, New Delhi ["DIAC"], and will be governed by the Rules of DIAC, including as to remuneration of the learned arbitrator. 7.

The learned arbitrator is requested to furnish a declaration under Section 12 of the Act, prior to entering upon the reference. 8.

All rights and contentions of the parties are left open for adjudication by the learned arbitrator.

The petition stands disposed of with the aforesaid directions.
