An application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of interim bail in FIR No. 309/2023 under Sections 302/365/34 IPC registered at P.S.: Alipur on the ground that petitioner intends to get his minor children admitted in school. Chargesheet has been filed under Section 302/365/120B/201/34 IPC.

As per status report handed over by learned APP for the State, presence of petitioner, in specific, is not required for the admission of his minor children and either of the parents or guardian can get them admitted in school, if so desired.
