The present application is filed seeking grant of regular bail in FIR No.425/2021 dated 02.08.2021, under Sections 302/307/34 of the Indian Penal Code, 1860 ('IPC') registered at Police Station Bharat Nagar.

The bail application filed by the co-accused Raghuvender was disposed of by a Coordinate Bench of this Court by order dated 12.01.2024 directing the learned Trial Court to complete the trial within two months from the date fixed for examination of the remaining witnesses. It is pointed out that all the witnesses have been examined and only Doctor Vijay who certified that the victim was fit to give statement remains to be examined. 5.

The learned counsel for the applicant submits that more than six months have elapsed since the passing of the order by this Court and the trial has still not completed. He further submits that the dying declaration by the victim was not given in the presence of the doctor and one of the witnesses has already turned hostile.

Considering the fact that the trial is at fag end, this Court does not consider it apposite to entertain the present application on merits. However, since this Court by order dated 12.01.2024 had directed the trial to be completed expeditiously, the learned Trial Court is once again requested to expedite the completion of trial within a period of three months from the date. 7.

The application is dismissed with the aforesaid observations.

Needless to state, the applicant is at liberty to address all arguments on merits before the learned Trial Court at an appropriate stage.
