O R D E R

% 23.02.2026 1.

When the present matter was taken up on 09.01.2026, the following facts were captured:- "1 The present FIR has been registered on the basis of the statement of complainant-Farukh whose sister had committed suicide.

As per the allegations, the accused was interested in marrying sister of Farukh but she was not inclined and since she refused to marry him, the petitioner, allegedly, transmitted certain photographs and videos of her, along with certain messages, to the brother of the complainant on 25.09.2023. 3.

The sister of the complainant committed suicide on same day i.e. 25.09.2023 itself.

The case of the prosecution, primarily, rests upon the testimony of complainant-Farukh whose examination is under way and is held up because of the fact that the FSL report has yet not been received.

The petitioner has been in custody for last 27 months. 6.

that the report with respect to the data contained in mobile is forensically examined without any further delay and the report and the exhibits are accordingly sent to the concerned Court/concerned SHO within four weeks from today. 7.

Any belated action or non-compliance shall be viewed seriously as it is affecting the liberty of a person who is languishing for last 27 months.

The next date for recording of evidence is stated to be 20.03.2026 and once the report and exhibits are received from the FSL, learned Trial Court would be at liberty to prepone the date for the purposes of completing the evidence of the complainant- Farukh."

It has now been informed by learned counsel for the applicant that Farukh has already entered into witness box and has been examined, cross-examined and discharged.

Learned counsel for the applicant submits that pursuant to the directions given by this Court, the FSL report has been prepared and placed on record and he has even received copy of such report. He supplements that such report does not indict him any further.

Be that as it may, fact remains that the applicant is in custody since 10.10.2023. His Nominal Roll has also been placed on record, which does not disclose his involvement in any other case.

Keeping in mind the overall facts of the case, albeit, without expressing any opinion over the merits of the case, the applicant is directed to be released on bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate with following conditions:- (i) The applicant would provide his Mobile Number to the concerned I.O and would ensure that such Mobile Number The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

remains active and operational, till the disposal of the case by the learned Trial Court.

(ii) The application would appear on each and every date of hearing before the learned Trial Court.

(iii) The applicant would not try to come in contact of complainant and his family members, directly or indirectly. 6.

The application stands disposed of in aforesaid terms. 7.
