Learned counsel for the parties submits that vacant, peaceful and physical possession of the subject premises has been handed over to the respondent/ landlord. In fact, an affidavit alongwith certain documents to that effect has also been executed on 21.04.2025, copy whereof has been handed over, and taken on record. Learned counsel for the petitioner identifies the signature of the petitioner at each of the places in the aforesaid documents including those on the affidavit executed by him on 21.04.2025.

In view of the aforesaid, and as held by the Hon9ble Supreme Court in N.C. Daga vs. Inder Mohan Singh Rana [2003(1) SCC 453] and Vinod Kumar Verma vs. Manmohan Verma & Anr. [Civil Appeal Nos.5220-5221 of 2008, order dated 19.08.2008], the present petition has become infructuous as there is nothing surviving therein.
