The plaintiffs and defendant No. 1 have arrived at a settlement in the course of mediation proceedings. A copy of the settlement agreement dated 02.05.2024 has been placed on record.

The settlement agreement is signed by the plaintiffs through their constituted attorney - Mr. Kishan Kumar Saini. Special powers of attorney executed by plaintiff Nos. 1 and 2 in favour of their attorney on 15.08.2023, and by plaintiff No. 3 in favour of the same attorney on 16.08.2023, have been annexed to the settlement agreement. 3.

Defendant No. 1 has also signed the settlement agreement through an attorney authorised by a special power of attorney dated 15.08.2023, a copy whereof has been placed on record.

Learned counsel for the parties request that the suit may be decreed, as between the plaintiffs and defendant No. 1, in terms of the settlement agreement dated 02.05.2024.

Mr. Rajesh Kr. Malhotra, learned counsel for the plaintiffs, states that defendant Nos. 2 to 4 were impleaded only as pro forma parties and no relief was sought against them. He does not press the suit as far as defendant Nos. 2 to 4 are concerned.

Having regard to the aforesaid submissions, there does not appear to be any impediment in granting the relief sought. 8.

The suit is decreed, as between the plaintiffs and defendant No. 1, in terms of the settlement agreement dated 02.05.2024. The suit is dismissed as not pressed as against defendant Nos. 2 to 4. 9.

The decree sheet be prepared in terms of the settlement agreement dated 02.05.2024, which will form part of the decree. 10.

All pending applications stand disposed of.

In view of the fact that the parties have settled their disputes in mediation, the Registry is directed to refund the court fees to the plaintiffs in terms of Section 16 of the Court-Fees Act, 1870.
