The present petition has been filed by the Petitioner - Pawan Kumar Saksena under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondents to permit the Petitioner to participate in the survey conducted by Town Vending Committee (hereinafter, 'TVC') of the New Delhi Municipal Council (hereinafter, 'NDMC').

Delhi. According to the Petitioner, his father was an eligible vendor and was vending at the said site. The father of the Petitioner passed away on 9th June 2021. The Petitioner prays that the Respondents shall consider the Petitioner in place of his deceased father for all purposes. Ld. Counsel for the Petitioner relies upon various challans in support of the same. Ld. Counsel for the Petitioner further submits that he may be permitted to participate in the survey.

On behalf of the NDMC, various discrepancies have been pointed out on the identity of the Petitioner's father, who is at some places is described as Sh. Lakha Ram and in others, he is described as Sh. Ram Narayan Saksena. 6.

Heard. It is not clear as to what is the actual identity of the Petitioner. Under these circumstances, no directions can be given for participation in the survey conducted by the TVC.

However, it is directed that the representation of the Petitioner may be dealt by the NDMC in accordance with law.
