By way of present petition, the petitioner seeks quashing of FIR bearing no. 404/2022, registered at Police Station Shastri Park, for the commission of offence punishable under Sections 363/376 of the Indian Penal Code, 1860 (hereafter 'IPC') and Section 6 of Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act') . 2.

The petitioner and respondent no. 2 are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Shastri Park, Delhi. 3.

Briefly stated, facts of the present case are that on the basis of a complaint of respondent no. 2, the present FIR was registered on 26.04.2022 against the petitioners under the relevant section. Thereafter, the petitioner and respondent no. 2 were married on 24.07.2023. from the said wedlock.

It is stated that both the parties have amicably settled the present matter and the voluntary affidavit of respondent no. 2 is placed on record, stating therein that she has no objection in quashing of the present FIR. 5.

On a query made by this Court, respondent no. 2 who has been identified by the concerned IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties. Respondent no. 2 further state that she has no objection if the present FIR is quashed. 6.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 7.

Accordingly, FIR bearing No. 404/2022, registered at Police Station Shastri Park, for the commission of offence punishable under Sections 363/376 of the Indian Penal Code, 1860 (hereafter 'IPC') and Section 6 of POCSO Act and all consequential proceedings emanating therefrom are quashed.

In view of the above, the present petition stands disposed of. 9.
