In view of the judgment of the Supreme Court in the case of Indian Performing Rights Society Ltd. Vs. Sanjay Dalia and Anr. (2015) 10 SCC 161, it is agreed that this Court would not have territorial jurisdiction. It is further agreed that the suit be transferred to the competent Court functioning Court under District & Sessions Judge, Ernakulam, Cochin, Kerala. 2.
Accordingly this case is returned under Order 7 Rule 10 CPC, to be filed before the competent Court functioning under the District & Sessions Judge, Ernakulam, Cochin, Kerala.
