The Petitioners' allegation is that the average sale price of iron ore across several months has been determined, without due application of mind and in violation of rules of Mines and Minerals (Development and Regulation) Act, 1957. The Petitioners have pointed out that prior to the filing of the present petition, Petitioner No.1 had submitted representations dated 23rd February, 2024 followed by a reminder dated 22nd April, 2024 to Respondent No.2, wherein they have highlighted their grievances. The aforenoted representations have not been responded to till date. 2.

Considering the nature of controversy in the present matter, at the first instance, in the opinion of the Court, Respondent No.2 must take a decision The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. on Petitioner No.1's representation, before the Court were to examine the allegations urged by the Petitioners, regarding violation of their fundamental rights.

In view of the above, the present petition is disposed of with a direction to Respondent No. 2 to take a decision on the aforenoted representations, within two months from today. The Petitioners have also requested for personal hearing with regards to the said representations. Considering that Petitioner No.1 is a federation of Indian mineral industries representing interest of the industry, Respondent No. 2 is also directed to afford an opportunity of personal hearing to the representative of the Petitioners.

It is made clear that in case the outcome of the Petitioners' representations is adverse to their interest, they shall be free to take recourse to appropriate remedies in accordance with law. 5.

It is clarified that the Court has not examined the merits of the case and all rights and contentions of the parties are left open. 6.
