O R D E R

The counsel for the plaintiffs and the counsel for the defendants no. 1 and 2 are permitted to hand over the application under Order XXIII Rule 3 of the CPC in the Court and the same is taken on record and be got numbered.

I have perused the compromise arrived at between the plaintiffs on the one hand and the defendants no. 1 and 2 on the other hand and find the same to be lawful.

The application under Order XXIII Rule 3 CPC is allowed and disposed of.

4.

A decree is passed, in favour of the plaintiffs and against the defendants no.1 and 2, in terms of the application under Order XXIII Rule 3 of the CPC, which shall form part of the decree sheet. CS(COMM) 599/2019

5.

The counsel for the defendants no. 1 and 2, in terms of para 3(i) of the compromise application has handed over two demand drafts to the counsel for the plaintiffs and which have been accepted by the counsel for the plaintiffs.

6.

The undertakings of Mr. Pravin Purohit and Mr. Narayan Ram Luhar as contained in the compromise application are accepted and the defendants no. 1 and 2 and the said Mr. Pravin Purohit and Mr. Narayan Ram Luhar are ordered to be bound thereby and cautioned through counsel of the consequences of breach thereof.

Decree sheet be prepared.
