Present application has been filed by the appellant seeking withdrawal of the present appeal filed under Section 37 of the Arbitration and Conciliation Act, 1996.

Learned counsel for the appellant states that pursuant to the Settlement Agreement dated 29th March, 2023, the appellant in accordance with Clause 2.1 (a) of the Settlement Agreement has made a payment of USD 875,000/- to the respondent by way of SWIFT transfer on 12th February, 2024.

Learned counsel for the respondent confirms receipt of the said payment under the Settlement Agreement.
