O R D E R
% 16.05.2017 The respondent was held guilty and convicted for offence under Section 138 of Negotiable Instruments Act, 1881 in appeal by judgment dated 2nd February, 2017. When the case has reached at the stage of handing down the sentence the parties have amicably resolved the dispute and have come up with joint application (Crl.M.A.8208/2017) seeking to compound. The application is supported by affidavits both of the appellant (complainant) and second respondent (convict). It may be mentioned here that on 8.5.2017, the Court was informed by the parties that the convict had handed over and the complainant had received a cheque in the sum of Rs. 8 lakhs for full and final settlement of the claims of the latter. The cheque has since been encashed and the proceeds thereof have been received by the complainant.
Against this backdrop, the prayer in the application is allowed, the offence having been lawfully compounded, the proceedings, come to an end. The appeal is disposed of in these terms.
