A Niyazi, learned counsel for CBSE submits that in pursuant to the direction of this Court vide order dated 27.11.2024, CBSE has passed following communication dated 28.02.2025 which reads as under; <BSE/AFF12730775/SS-90725-2324/2025/00384 dated 28.02.2025 The Manager/Principal, Khadijatul Kubra Girls Public School 8/1 Joga Bai, Jamia Nagar, New Delhi-110025.

Subject: Compliance of order dated 27.11.2024 in WPC. No. - 13969/2023 for Upgradation up to Senior Secondary Level vide Application no SS-90725-2324 regarding.

Madam/Sir, This is in reference to your Application No. SS-90725-2324 for Upgradation up to Senior Secondary level. It is informed that the physical inspection of the school was conducted on 03.02.2025 in compliance to the directions passed vide order dated 27.11.2024 by the Hon' ble High Court of Delhi (WPC 13969/2023). The Competent Authority of the Board on the recommendations of the inspection committee has accorded in-principle approval for the grant of Upgradation to school up to Senior Secondary Level with 24 sections from class I to XII w.e.f. 2025-26 session, as per Affiliation Bye-Laws of the Board.

In this connection, you are requested to submit an affidavit from a first class Magistrate within 07 days to be signed by the Manager and Principal of the school that it shall not run more than 24 sections in all from class Ist to XIIth and that it shall also bring existing number of sections from 27 to 24 only.

The grant of upgradation shall be processed in SARAS portal on receipt of the affidavit from the school.= Learned counsel for the CBSE submits that conditions as mentioned in the communication dated 28.02.2025 are mandatorily required to be complied with, by the petitioner.

Learned counsel for the petitioner submits that in view of the order of CBSE dated 28.02.2025, the petitioner does not want to pursue the present petition.

In view of the above, the present petition along with pending applications stand disposed of.
