Chetan Shah v. Union of India, 2024 SCC OnLine Bom 1195. 3.
It is stated that though Special Leave Petitions challenging the said Judgment have been filed, however, there is no stay of the said Judgment passed by the High Court of Bombay. The effect of the same is that the Office Memorandum dated 22.02.2021 itself does not exist. The Judgment of the High Court of Bombay has been passed post the impugned Judgment, therefore, rendering the present appeal as infructuous. 4.
The instant appeal is disposed of as infrucutous along with pending application(s), if any.
5.
It is made clear that this Court has not gone into the merits of the case. Liberty is granted to the Appellant to take such steps in case the Judgment of the High Court of Bombay is set aside or any stay of the said Judgment is granted by the Apex Court.
