Learned counsel for the plaintiff states that parties have arrived at settlement before the Delhi High Court Mediation & Conciliation Centre and have executed the settlement agreement dated 09.05.2024. 1.1 He states in view of this settlement all claims of plaintiff qua the defendant as stated in the plaint stand satisfied. 1.2 He states that the plaintiff, therefore, seeks to unconditionally withdraw the present suit. He prays that since the suit is at initial stage, 50% Court fees may be refunded to him under the Court Fees Act, 1870 in favour of the plaintiff.

The plaintiff and defendant are present in person and have joined the proceedings through video conferencing alongwith their counsel. Plaintiff and defendant have also confirmed the aforesaid satisfaction of the claims. 3.
In view of the submission of the plaintiff that all his claims stand satisfied and that the plaintiff has no cause of action to continue with this CS(OS) 685/2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. suit against the defendant, the present suit is dismissed as withdrawn, with no liberty reserved.

Keeping in view that request made by the counsel for the plaintiff, the registry is directed to release 50% of the Court fees in the name of the plaintiff within four (4) weeks in accordance with Rules. 5.
Pending applications stand disposed and all future dates stand cancelled.
