This application has been filed by petitioner seeking urgent directions in light of the fact that the Special Leave Petition ('SLP') filed by respondent/Municipal Corporation of Delhi ('MCD') has been dismissed on 21st April 2025 by the Supreme Court in SLP(Civil) Diary No.47895/2023. 2.

Accordingly, the orders passed by this Court on 19th April 2023 in CM(M) 1440/2022 have, therefore, crystalized and must be actioned. The timeline which was given in the order dated 19th April 2023, was of four weeks.

Counsel for respondent along with the Assistant Engineer, Mr. Arvind Choudhary, is present in Court. They state that all remedies have been exhausted and they are duty-bound to comply with the orders. The original application for sanction, which was done on an online basis, has since expired, considering that it remains pending for only sixty days as per their procedure.

A fresh application shall be filed by the petitioner within a period of one week.

There shall be written communication shared between the counsel for petitioner and the counsel for respondent with respect to any deficiencies which are noted in the application, and the same shall be duly rectified by petitioner in consultation with respondent/authority, who shall collaborate to ensure that the application is complete for processing. 7.

The processing shall be done within the next six weeks thereafter, to allow for a buffer for completion of any ministerial formalities. 8.

The officer is present in Court and also undertakes on behalf of the MCD that the same shall be complied with.

Accordingly, the application is allowed and is disposed of. CONT.CAS(C) 1565/2023 1.

The petition is disposed of in accordance with the directions passed above, with liberty to petitioner to revive the petition in case if there is any continued infraction.
